Estimate. Vacation days are working days: public holidays inside the period do not count. The tax-free part applies when the employer gives the premium to all staff.
How vacation days and the premium are calculated
The 2023 table
Article 76 of the Federal Labor Law, reformed in December 2022: 12 working days after the first year, 14, 16, 18 and 20 in years 2 to 5, and from year 6 two more days every five years: 22 (6 to 10), 24 (11 to 15), 26 (16 to 20), 28 (21 to 25), 30 (26 to 30), 32 (31 to 35).
The premium
Article 80 adds a premium of at least 25% on the salary of the vacation days. A contract or collective agreement can give more: type it in the optional block.
When you take them
At least 12 days in a row, the rest as the worker decides (art. 78), within the six months after completing the year (art. 81). Vacation cannot be swapped for money while the job goes on (art. 79).
When the job ends
Before completing a year, the vacation is paid in proportion to the time worked (art. 79), with its premium. That calculation lives in the finiquito calculator.
Income tax
The vacation premium is free of ISR up to 15 days of UMA per calendar year when it is given to all staff (LISR art. 93, fraction XIV). UMA 2026 = 117.31, so 15 UMA = 1,759.65 pesos. The vacation pay itself is ordinary salary.

Examples
Monthly salary of 12,000, first year completed
Daily salary 400. 12 days × 400 = 4,800.00 of vacation pay. Premium 25% = 1,200.00, all of it within the 1,759.65 free of ISR.
Monthly salary of 12,000, three years of service
16 days × 400 = 6,400.00. Premium 1,200.00 becomes 1,600.00. Vacation pay + premium = 8,000.00. At four years: 18 days.
Daily salary of 1,500, seven years of service
22 days × 1,500 = 33,000.00. Premium 8,250.00: 1,759.65 free of ISR and 6,490.35 taxable. The next step is 24 days at eleven years.

Questions
How many vacation days do I get in 2026?
12 working days after the first year, 14 after the second, 16, 18 and 20 after the fifth. From year 6, two more every five years: 22 from 6 to 10 years, 24 from 11 to 15, and so on.
How much is the prima vacacional?
At least 25% of the salary of your vacation days (LFT art. 80). With 12 days and a daily salary of 400, the vacation pay is 4,800 and the premium 1,200.
Is the prima vacacional paid on all the days or only on the ones I take?
It is calculated on the salary of the vacation days, so it follows the days you take. If you split the period, each part carries its premium.
Does the prima vacacional pay income tax?
Only above 15 UMA in the calendar year (1,759.65 pesos in 2026), when the employer gives it to all staff (LISR art. 93, fraction XIV). The rest is taxed with your salary.
Can my employer pay me the vacation instead of giving the days?
No. Vacation cannot be swapped for money while the job continues (LFT art. 79). It is paid in money only when the job ends, in the finiquito.
Is this the exact amount I will get?
It is an estimate with the Federal Labor Law. Your contract can give more days or a higher premium. Your numbers stay in your browser: nothing is uploaded or saved.
