How overtime is calculated
Hourly rate
The monthly salary divided by the monthly hours divisor (CLT art. 64). For 44 hours a week the payrolls use 220; for 40 hours, 200 (TST Súmula 431); the same rule (weekly hours × 5) gives 210 for 42 hours and 180 for 36 hours. A union agreement can set another.
50% at least
Each overtime hour is worth at least 50% more than the normal hour (Constitution art. 7 XVI, CLT art. 59 § 1). The base is the hour with every salary-type premium (TST Súmula 264).
Sundays and holidays
Work on a Sunday or holiday that is not compensated with another day off is paid double, besides the paid rest itself (Lei 605/1949 art. 9, TST Súmula 146): that is the 100% rate.
Night work
Between 10 pm and 5 am each hour counts as 52 min 30 s and earns at least 20% more (CLT art. 73). For night overtime the night premium enters the base before the 50% (TST OJ SDI-1 97).
Weekly rest reflex
Regular overtime raises the pay of the paid rest days (Lei 605/1949 art. 7, TST Súmula 172), and so does a regular night premium (TST Súmula 60): total ÷ working days × Sundays and holidays of the month.
Shorter week from December
Constitutional Amendment 141/2026 (published 16 Oct 2026) lowers the maximum week to 42 hours from 16 Dec 2026 and to 40 hours from 16 Dec 2027, with 2 paid rest days a week from 16 Dec 2026 and no pay cut. Pick the divisor of the period you are calculating.

Examples
R$ 2,200, divisor 220, 10 h at 50% and 2 h at 100%
Hourly rate R$ 10.00. Overtime R$ 15.00 × 10 = R$ 150.00; Sunday hours R$ 20.00 × 2 = R$ 40.00. With 25 working days and 5 Sundays and holidays the weekly rest reflex is R$ 38.00. Total R$ 228.00.
R$ 3,000, 40 hours a week (divisor 200), 20 h at 50%
Hourly rate R$ 15.00, overtime hour R$ 22.50, 20 hours = R$ 450.00.
R$ 2,200 and 7 clock hours at night
7 clock hours count as 8 night hours. Night premium R$ 10.00 × 20% = R$ 2.00 an hour, × 8 = R$ 16.00.

Questions
How is overtime calculated in Brazil?
Divide the monthly salary by the divisor (220 for a 44 hour week) to get the hourly rate, add at least 50% and multiply by the overtime hours. Hours on uncompensated Sundays and holidays are paid double.
Divisor 220 or 200?
220 for 44 hours a week, 200 for 40 hours (TST Súmula 431). With Constitutional Amendment 141/2026 the week drops to 42 hours on 16 Dec 2026 and 40 hours on 16 Dec 2027, so the divisor of payrolls will follow the hours of each period.
What is the overtime reflex on the weekly rest (DSR)?
Regular overtime also raises the pay of Sundays and holidays: the overtime of the month divided by the working days, times the rest days. It appears as a separate line on the payslip.
How many overtime hours can be worked?
Up to 2 a day, by individual or collective agreement (CLT art. 59). An hour bank can compensate them with time off instead of pay.
Does everyone have overtime?
Not everyone. Overtime is owed where the working hours are controlled, and Amendment 141/2026 lets employees with a university degree who earn at least 2.5 times the INSS benefit ceiling go without hour control, unless the employer or a union agreement says otherwise.
Is this the exact amount of my payslip?
It is a simulation with the rules in force on 16 Oct 2026. Union agreements often set higher rates, other divisors or other ways to count the days. Your numbers stay in your browser: nothing is uploaded or saved.
